Terms of Service

These terms cover the NEWNOW service: the website we build for you, the business phone line, the AI receptionist, the lead system and the automation, together sold as one system. They're written to be read, not to be survived. If something here is unclear, write to us before you sign it.

The service

NEWNOW designs, builds, launches and operates a connected system for your business: a website, a business phone line, an AI receptionist, lead capture and routing, and automated follow-up. NEWNOW Launch covers design, build, training and launch. NEWNOW Managed covers hosting, AI system management, maintenance and updates, the lead system, ongoing optimization and support, within our standard usage policy. Businesses with unusually high call volume, advanced integrations or custom requirements may require a different plan, which we confirm in advance.

Fees

Setup is $2,500, payable before work begins or half at kickoff and half at launch. The service fee is $299 per month, billed monthly in advance, starting the day your system goes live. Prices are in U.S. dollars and exclude any applicable taxes.

Term and cancellation

Your service terms are explained clearly before you begin. Your domain remains yours. If you cancel, ongoing NEWNOW services stop according to your agreement, and we provide the appropriate transition information for your domain and phone setup. Setup fees are non-refundable once build work has begun.

Ownership

You own your domain, your content, your customer data and the website design we produce for you. NEWNOW retains ownership of its own platform, tooling, templates and AI configuration methods, none of which are exclusive to any one client.

Your responsibilities

You are responsible for the accuracy of the business information you give us — services, prices, hours, service area and licensing — and for making sure your use of the phone line and messaging complies with applicable law, including consent rules for calls and text messages.

The AI receptionist

The AI receptionist is an automated system. It is built to hand off to a human when a request falls outside what it should decide, but it is not a licensed professional and does not give legal, medical or financial advice on your behalf. You are responsible for reviewing the leads and messages it produces.

Availability

We aim for continuous availability and maintain backups and monitoring, but we do not guarantee uninterrupted service. Where an outage is within our control, we fix it as a priority and, for significant outages, credit the affected period.

Limitation of liability

To the extent permitted by law, NEWNOW's total liability arising from the service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect or consequential losses, including lost business.

Changes

We may update these terms. If a change materially affects you, we'll tell you at least thirty days before it takes effect, and you may cancel without penalty if you don't accept it.
